Role Responsibilities

Do you have a background working with administrative tribunals and want to put your knowledge and experience to great use? Service Alberta and Red Tape Reduction’s Tenancy Dispute Officer is for you!

As an integral part of the Residential Tenancy Dispute Resolution Service (RTDRS), Tenancy Dispute Officers report to a Tenancy Dispute Officer Team Lead and adjudicate conflicts arising between landlords and tenants under the Residential Tenancies Act (RTA), the Mobile Home Sites Tenancy Act (MHSTA), and related regulations. The RTDRS offers residential landlords and tenants an alternative to the court system for resolving RTA and MHSTA disputes.

As the Tenancy Dispute Officer, you will arrange and conduct impartial hearings to obtain information and evidence relating to applications for remedies under the RTA or MHSTA. You will evaluate and analyze evidence and applicable laws, regulations, policy and precedent decisions to determine conclusions. You will inform parties on the nature of the proceedings to ensure there is a clear understanding of the process; question witnesses to obtain information; rule on exceptions and admissibility of evidence; obtain additional information to clarify evidence; provide parties with oral or written decisions; and assess costs (if any) as are appropriate to the circumstances.

In your role as the Tenancy Dispute Officer, you will make use of a wide range of advanced skills in judgement and decision-making, including your ability to assess the strengths and weaknesses of the evidence presented; to choose the appropriate remedy; to communicate effectively with the parties including superior active listening, speaking and writing skills; to interpret and apply applicable legislation and regulations;; to use Office365 and related computer programs; and to operate within an online case management system. You will be working independently with minimal direct supervision. Established “Rules of Practice and Procedure” and “Code of Conduct for Tenancy Dispute Officers” define the operating guidelines for hearings and file handling. You may be required to act as Team Lead on occasion.

Tenancy Dispute Officers conduct 5-10 hearings daily. You are comfortable with a fast-paced environment and an often-heavy workload.

Qualifications

Minimum Requirements:

University degree in a related field (Public Administration, Business, Commerce, or Law) or equivalencies
• Minimum of 4 years experience on an administrative tribunal or in an adjudicative capacity
• Experience with or knowledge of Alberta’s residential tenancy legislation and other provincial and federal statutes that may impact the hearing process (Charter of Rights and Freedoms, Provincial Offences Procedures Act, Alberta’s Minimum Housing and Health Standards, and the Civil Enforcement Act.)
• Eligible to meet the requirements to become a Commissioner of Oaths

Equivalencies:

One year of education for one year of related experience or one year of related experience for one year of education.

Assets:
• Formal training/certification in decision-making, conflict resolution process such as arbitration, mediation, and conciliation along with practical experience demonstrating these skills.
• Experience with or knowledge of administrative law and the operation and functioning of administrative tribunals in Alberta and/or other jurisdictions.
• Experience with or knowledge of basic legal terminology.

Strong written communications skills are required for this position. A written assessment will be conducted for short-listed candidates.
